These terms

These Terms of Service ("Terms") govern your use of the websites and products operated by Vanillapha Inc. ("Vanillapha", "we", "our", "us"), a Canadian corporation federally incorporated and registered to operate in Ontario, Canada. By using a Vanillapha product or service, you agree to these Terms.

Your account

You are responsible for your account credentials and for activity that occurs under your account. You must provide accurate registration information and keep it current. We may suspend or terminate accounts that violate these Terms or applicable law.

Acceptable use

You agree not to use a Vanillapha Service to:

  • Break applicable law or infringe the rights of others.
  • Upload content you do not have the right to upload.
  • Probe, scan, or test the Service for vulnerabilities without our written permission.
  • Use the Service to harass, defame, or harm another person, or to record audio in a way that violates applicable privacy or consent law.

Your content

You retain ownership of content you create or upload to the Services. You grant Vanillapha the limited rights it needs to host, transmit, process, and display your content for the purpose of operating the Service for you.

Vocert and legal information

Vocert is an analysis tool, not a substitute for legal advice. The analysis, summaries, and recommendations produced by Vocert are informational and may contain errors. Always consult qualified counsel before relying on Vocert output in a legal proceeding.

Subscriptions and payments

Paid plans may be offered through our websites or through the Apple App Store. Subscriptions purchased through Apple are governed in part by the Apple App Store terms. Where applicable, taxes are charged in accordance with local law.

Disclaimer and limitation of liability

The Services are provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

Termination

You may stop using the Services at any time and delete your account. We may suspend or terminate access if you breach these Terms or use the Services in a way that creates legal or operational risk for us or other users.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles. The exclusive venue for disputes is the courts located in Ontario, Canada.

We may update these Terms. If we make material changes, we will update the date above and, when appropriate, notify you in the Service.
